insurance claim for helmet and jacket??

i dont have any receipts i gpot knocked off me x-11 and shes owned up to it so im going through a claim i spoke to my insureres swinton about my helmet and jacket and they say provide receipts has anyone had any experiance with claiming for a lid and jacket and gloves etc?let me konw what to do pleeeese?

You should not have to provide reciepts, get a wrotten quote from any bike shop for new gear and this shoyld be enough for them.

Claimed a few years back for a helmet, and as Stu said, only had to get it valued by a bike shop. Didn't need proof of purchase. What make is your helmet?

You have every right to claim for a new helmet as any helmet that has been damaged as a result of an RTA must be replaced to comply with the road traffic act. As they said previously, get a quote from a shop for a replacment, keep your original until the claim is settled, and the shell doesnt have to show extensive damage to reuire replacment, simply dropping it on a hard surface is sufficient to compromise the integrity,Any problems or questions relating to this and give specialist bike solicitors White Dalton a call, usually they will advise you for free.

When i got knocked off the bike, i took photo's of the damage on my lid and mailed them to the solicitor's with the receipts from when i bought it.

If the helmet you bought say 2yrs ago was

Morning.

I worked in motor claims for longer than I care to remember. Their attitude will depend upon the policy of the company or even the individual claims handler you are dealing with.

Their legal liability to you is to pay the value of your kit at the time of the accident, not it's replacment value. They are therefore entitled to ask for original purchase receipts to prove cost and age and then apply a reduction, typically 20% a year to calculate the current value. The theory is the helmet or kit would be worthless after 5 years, so it reduces it's value 20% per year. So if you show them evidence you bought kit for

Yep, that happens - as I said, it's very much down to the company or handler you are dealing with. Some will take the more pragmatic approach of "just pay it" rather than enter into more correspondence - others will fight tooth and nail - there is no protocol.

But, the legal position is that they are only liable for the market value of the items at the time of the accient, not the original value, exactly the same as they will only pay the market value of a total loss, not the original purchase value.

I'm in the same position.

My solicitors acting on a claim that is running at the moment asked for receipts, I laughed at them saying who keeps receipts for things for that long? :icon_scratch:

They advised me to look for a like-for-like replacement and said they will put that amount in the claim and see what happens.

Like wise my Jacket, trousers, sunglasses B), boots, gloves, socks, shirt and t-shirt!! (well they all got cut off by the :police: ambulance crew!)
